Welcome to Smilyra! These Terms of Service ("Terms") govern your access to and use of the Smilyra website, mobile applications, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

By creating an account, making a purchase, posting content, or otherwise using the Smilyra Service, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing or using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Smilyra reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or incomplete.

Smilyra strives to provide accurate descriptions and images of our products. However, we do not warrant that product descriptions, colors, dimensions, or other content on the Service are entirely accurate, complete, reliable, current, or error-free. If a product offered by Smilyra is not as described, your sole remedy is to return it in unused condition.

All prices are listed in the applicable currency and are subject to change without notice. The final price for an order will be confirmed at checkout and will include product costs, shipping fees, and applicable taxes. You agree to pay all charges incurred by you or on your behalf through the Service, at the prices in effect when such charges are incurred.

For EU customers, prices displayed will include VAT where applicable, and shipping costs will be clearly indicated before the final purchase confirmation.

Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.

Smilyra will arrange for shipment of the products to you. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or other factors beyond our reasonable control.

For international shipments, you are responsible for any customs duties, taxes, or import fees levied by the destination country. These charges are not included in the product price or shipping cost and are your sole responsibility.

Our return policy allows for returns of unused products within 14 days from delivery. For EU consumers, you have a statutory right of withdrawal of 14 days from the day you acquire physical possession of the goods, without giving any reason. Smilyra allows users to post reviews, comments, photos, and other content ("User Content"). You are solely responsible for your User Content and the consequences of posting or publishing it.

By submitting User Content, you grant Smilyra a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and Smilyra's business, including for promoting and redistributing part or all of the Service in any media formats and through any media channels.

THE SMILYRA SERVICE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND OTHER SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SMILYRA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS MADE AVAILABLE THROUGH THE SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY LAW, SMILYRA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL SMILYRA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, ANY THIRD-PARTY CONDUCT OR CONTENT ON THE SERVICE, OR UNAUTHORIZED ACCESS TO YOUR TRANSMISSIONS OR CONTENT.

These Terms, together with the Privacy Policy and any other legal notices published by Smilyra on the Service, constitute the entire agreement between you and Smilyra concerning the Service.

If any provision of these Terms is deemed invalid, unlawful, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.
